Terms and Conditions


1. Definition

In these Terms and Conditions (unless otherwise stated in the context):

Booking request - means the reservation that the customer made on the website to book the service to be performed on a certain date, time, place and that stipulating the fees for the service.

Booked Services - means the cleaning services the Customer has requested in the Booking Request on the website, if needed, Bensa will provide the rectification services to provide the cleaning service that was stated in the booked services on the website in a Customer Dispute in accordance with the terms of this Agreement.

Booked Service Fee - means the total fee that the customer will pay for the booked services that was requested by the customer in the booking request.

Booked Service Location - means the address where the booked services will be carried out, provided by the customer in the booking request.

Cleaning Agreement - means the agreement between you as a customer and Bensa, covering that the Booked Services will be provided by Bensa in according to your Booking Request.

Cleaning Product Fee - means the additional fee that will be paid by the Customer when the customer request Bensa to provide Bensa’s Cleaning Products and Equipment to complete the Booked Service mentioned in the Booking Request.

Cleaning Products and Equipment - means the cleaning products and equipment that Bensa has pre-­‐ approved and requires, to be able to complete the Booked Services that is requested in the Booking Request.

Customer - means any person or company who has registered with the Website, and has entered into this Agreement or any other related agreement as required, by submitting a Booking Request.

Intellectual Property Rights - means all property relating to Bensa, intellectual and industrial, including the Website, designs, drawings, technical information, models, specifications, prototypes, patents, applications for patents, trade secrets, confidential information, trade-­‐marks, trade-­‐names, discoveries and inventions.

Party - means you as a customer or Bensa individually.

Parties - means you as a customer and Bensa jointly.

Scheduled Booking Time - means the date and time stated in the Booking Request that the Booked Services are to be done by Bensa.

Site Content - means all information, material and content that is available on the Website including but not limited to written text, images, photographs, graphics, logos, trademarks, video material, audio material and any other forms of expression.

Website - means www.bensa.ae and associated applications.

You / Your - means you as the user of the Website, the customer, and as a party to this Agreement.

2. Interpretation

In these Terms and Conditions (unless otherwise stated in the context):

  • 2.1. headings are there only to make the use convenient and do not affect its interpretation or construction.
  • 2.2. the singular includes the plural, and the plural includes the singular.
  • 2.3. references to recitals, clauses, sub-clauses, paragraphs or schedules are references to recitals, clauses, sub-clauses, paragraphs and schedules of or to these Terms and Conditions.
  • 2.4. words referring to a gender include other genders.
  • 2.5. the word "person" means a physical person.
  • 2.6. the word "company" means a registered company represented by a person.
  • 2.7. where there is a definition of any word or phrase, there is a cognate meaning for that word or phrase in any other part of speech or other grammatical form.
  • 2.8. when referring to any statute, proclamation, rule, code, regulation or ordinance, this will include any amendment, consolidation, modification, re-enactment or reprint of it or any statute, proclamation, rule, code, regulation or ordinance replacing it.
  • 2.9. all amounts mentioned for payments, claims ore likewise are in United Arab Emirates currency.
  • 2.10. any reference to time refers to local time in United Arab Emirates.
  • 2.11. there is no limitation in the word "includes".
  • 2.12. no rule of construction applies to the disadvantage of Bensa because these Terms and Conditions are prepared by Bensa.
  • 2.13. a reference to any thing includes a reference to the whole and each part of it.
  • 2.14. a reference to a group of persons includes a reference to all of them together as well as to each of them individually.
  • 2.15. a reference to a document includes all the amendments or supplements or replacements or novations of the same document.
3. Terms and Conditions
  • 3.1. These Terms and Conditions governs the access to and use of this website.
  • 3.2. Bensa may review the Terms and Conditions periodically and reserves the exclusive right to change the Terms and Conditions. This may be done without any prior notice to you, only by updating the Agreement. You should on a regular basis review this Agreement, that is available on the Website, since any changes to the Terms and Conditions takes an immediate effect from the date of the publication of this Agreement on the Website. Any continued use of the Website from your part will be deemed to constitute your acceptance of those changes of the amended publication Terms and Conditions.
  • 3.3. You acknowledge that any redirection tools or other hyperlinks that will take you to other websites or links operated by third parties that may appear on the Website ("Third Party Site") are not operated by Bensa and do not form part of the Website or the Agreement. You agree to not hold Bensa liable or in any way accountable for anything that occurs on the Third Party Site.
4. Acceptance to use
  • 4.1. To be able to use this Website, you must first agree to the Terms and Conditions to be able to make a Booking Request.
  • 4.2. To accept the Terms and conditions you will: (4.2.1) create a User Profile with the Website; and (4.2.2) click on the link that accept/agree to the Terms and Conditions.
  • 4.3. You are required to fill out Bensa's online registration form and send your completed form by clicking on the corresponding button after acknowledging your agreement to the Terms and Conditions to be able to create a User Profile. Once the above is completed, Bensa will send you an email with all details of your User Profile.
  • 4.4. Nevertheless clause 3.2, you can not accept the Terms and Conditions or access the Website if: (a) you are a person who under the law are prevented from entering into agreements, or (b) you are not of legal age to form a binding contract, in which case, you must immediately leave the Website
  • 4.5. By accepting these terms and conditions, you agree that they are not unreasonable, that there is no unfair bargaining power or position, that there is no compulsion, and that you have thoroughly read and understood the terms and conditions. If you completely or partially do not understand the Terms and conditions, you should seek independent legal advisor.
  • 4.6. You confirm that the information you provide is correct when you create a user profile. You also agree that you will update such information to ensure that your user profile is always up to date. A user profile can easily be updated, all you need to do is to log into your account and change the submitted information that needs to be updated.
5. Personal User Profile
  • 5.1. To be able to make a Booking Request you have to register your personal information on the Website such as your name, address, phone number, and email address ("User Profile").
  • 5.2. When you have registered your personal information you will be issued a username and password. These are linked to your user profile. The user profile with it's content is personal to you and are not transferable. If anyone is using your username and password, you are held responsible for all information posted on or transmitted via the Website and any payments due for the Booked Services acquired through the Website when used with your username and password. You should immediately notify us of any breach of security in your username and password.
  • 5.3. You are only entitled to register one User Profile with the Website. Bensa have the right, in its sole discretion to delete user profiles that deem duplication and to block and/or prohibit any user from further use of the website.
6. Use of the Website
  • 6.1. First you visit the Website and login to your User Profile to make a Booking Request. All Booking Requests are subject to the minimum time duration of 3 working-­‐hours. After you have submitted a booking request you will receive a Booking Request confirmation receipt from Bensa.
  • 6.2. When a Booking Request has been submitted, Bensa will then take your contact details, Booked Service Location, Scheduled Booking Time and the scope of the available timings to provide the cleaning service. When you submit a Booking Request, you consent to the disclosure of such information. A coordinator from Bensa will then confirm the available cleaning session and accept your Booking Request.
  • 6.3. If you would like to request a preferred cleaner to come for the cleaning, you may do so when you do your Booking Request. Bensa will take your requests into account when arranging the cleaning from the Booking Request. However, a requested Cleaner cannot be guaranteed due to the subject if the Cleaner is available at Scheduled Booking Time you have selected in your Booking Request.
  • 6.4. When Bensa has confirmed a Booking Request, you will receive an acceptance email from Bensa with an attached electronic version of the Cleaning Agreement that constitutes and governs the relationship between you and Bensa for the Booked Services that will be provided to you by Bensa. With this acceptance email Bensa will provide you with an invoice, In accordance with clause 6.4. All Cleaning Fees and Cleaning Product Fees will be handled by the Payment Service Provider.
  • 6.5. If the Booking Request for any reason cannot be facilitated, Bensa will do their best to arrange for an alternative time for the Cleaning Service with you.
  • 6.6.When you have engaged the services of a cleaners from Bensa, you warrant that you will not use the same cleaners other than through Bensa. If you differ from this provision it may result in fines for the Cleaner and your User Profile/account may be suspended indefinitely. Upon termination of the User profile/account, this clause shall survive for further five (5) years.
  • 6.7. The purpose of the Website for you is to enable you to make Booking Requests and complete payments for completed Booked Services.
  • 6.8. In accordance to use the Website with these Terms and Conditions, you confirm that you are at legal age to form a binding contract and possess the legal authority. You also guarantee that all information supplied by you on this Website is true and accurate at all times.
  • 6.9. It is prohibited to make any speculative, false or fraudulent Booking Request. You hereby agree that you will only use the Website to make legitimate Booking Requests accountable for you. You hereby agree that the misuse of the Website may result in you being denied access to the Website.
  • 6.10. The right to add, change or withdraw functions available on the Website, can be done at Bensa's sole discretion at any time.
  • 6.11.Advertising from your behalf on the Website is strictly prohibited.
7. Payment procedure
  • 7.1. At the time of the Booking Request you agree that all your payment details will be transferred to the Payment Service Provider for future processing.
  • 7.2. When Bensa has confirmed a Booking Request, Bensa will issue you an invoice. Once the invoice is issued, you agree to the automatic processing of payment of applicable Cleaning Fees and Cleaning Product Fees by the Payment Service Provider.
  • 7.3. Bensa will provide you a receipt stating that the Payment Service Provider will hold the Cleaning Fee and Cleaning Product Fee, if applicable, on behalf of Bensa, until they are remitted to Bensa or refunded to you if you are entitled to a refund. When the final receipt will be issued to you. Any amounts held by the Payment Service Provider will not entitle you to any payable interest.
8. Changes and Cancellations of Service
  • 8.1. A If you for any reason need to cancel or amend a Booking Request you may do so on the Website, free of charge, up to 24 hours before the Scheduled Booking Time.
  • 8.2. If a Booking Request that is cancel or amend within 24 hours of the Scheduled Booking Time, you will have to pay a cancellation fee that is equivalent to 50% worth of the Booked Cleaning Services.
  • 8.3. A Booking Request cannot be amended, extended or canceled during or after the performance of the Booked Services.
  • 8.4. Once the Booked Services have been completed the Cleaning Agreement will expire.
  • 8.5. Bensa will attempt to find you a replacement if the Cleaner is unable to complete the confirmed Booking Request (in full or part). If Bensa cannot find you a replacement for the Cleaner, Bensa will reschedule your Booking Request to a new time of your choice. You may cancel the Booking Request if Bensa. If the cleaning was done partial you only need to pay for the part cleaned. If the cleaning never started, and Bensa cannot find a suitable time for you, there will not be any cancellation charges.
9. Cleaning Services
  • 9.1. This Website is operated by Bensa to provide you with the service to easily purchase the Cleaning Services online.
  • 9.2. The Cleaners offered by Bensa can occasionally be monitored by one of Bensa's Cleaning Supervisors. You should notified Bensa as soon as 10 possible if there are any issues regarding safety, quality, condition or description. Bensa, who may, in its sole discretion, refer the issue to the Cleaning Supervisor designated for the Cleaner that had your Booking Request and an investigation will take place. For further information you can refer to the Terms and Conditions and the conditions of your Cleaning Agreement.
  • Bensa's Cleaning Supervisor and Management team will investigate any dispute, damage and or liability that may arise in connection with the performance of the Cleaner.
  • You have to inform Bensa's Management if you wish to commence legal proceedings in relation to the cleaner provided by Bensa.

10. Ratings
  • 0.1. On the Website for the Booked Services you can post ratings on the service Bensa provided ("Ratings").
  • 10.2. Any content in the ratings that may be offensive or abusive, liable to criminal prosecution or otherwise unlawful (e.g. content which infringes third parties' intellectual property rights) is not allowed. Ratings that violate this clause will be deleted or not published. Ratings can only be done while logged into your user profile and will identify the customer that has posted the Rating.
  • 10.3. When you sending in a rating you grant Bensa (free of charge) the full rights to use the text of the Rating without any territorial or time limitations.
  • 10.4. All ratings can be handled by Bensa as they sees fit, including publishing it, use it for further rating services or passing it on to a third party.
  • 10.5. Your User Profile can be suspended and/or terminated if there is any misuse of the ratings system. Any misuse is determined by Bensa and will be sorted by Bensa in sole discretion.
11. Termination
  • 11.1. Your user profile may at Bensa's sole discretion be terminated, or the access denied to, the Website at any time. Bensa may notify you by  email, if this will happen. If your use of the Website is terminated: 

                (11.1.1) you are no longer authorized to access the Website, create a new user profile or use any other services from Bensa with the details provided in your User Profile. These details include the email address you used to register with the Website and/or any other email address you may possess;

                (11.1.2) all disclaimers and limitations of Bensa's in the Terms and Conditions or elsewhere on the granted by you, will survive the termination.

  • 11.2. To terminate this agreement between you and Bensa, you have to email Bensa at info@bensa.ae, Bensa will then disable your User Profile within fourteen (14) days of receipt of the email where you request the termination of your User Profile.
  • 11.3. Any outstanding fees and charges owed by you to Bensa on your User Profile, Bensa reserves the right to deduct them prior to disabling the user profile. 
  • 11.4. You hereby authorize Bensa to deduct the above‐mentioned fees and charges, prior to the disabling of your User Profile. These fees and charges will be deducted through the payment details you contained in your User Profile. 
12. Policy on Dispute Resolution
  • 12.1. The parties will do their best efforts to resolve any disputes that may arise concerning the use of the website.
  • 12.2. If a dispute in relation to the booked service provided by Bensa, the resolution will be managed based on the term of the Cleaning Agreement.
13. Security of Payment
  • 13.1. When approving these terms and conditions you agree to that Bensa may collect and store your personal details. Bensa is hereby not responsible for any breach, disclosure, action, and loss or damage whatsoever arising from the collection and storage of your personal and other related details.
  • 13.2. From a technical and systems perspective Bensa has taken practical steps to ensure you that your information is protected. To process all transactions and credit card details, a payment gateway is used. Bensa is not responsible for any events associated with unauthorized access to your information. Bensa does not make any representation or give any warranty regarding the strength or effectiveness of the payment gateway.
14. Privacy Policy
  • 14.1. All the information that you enter into the User Profile, Bensa collects and stores. Bensa's Privacy Policy that is available on the Website, states how your personal information will be maintained.
  • 14.2. You agree and consent to that Bensa may use your information, including your name, address, email address, phone number, and any other information at the discretion to be used within the company in order for Bensa to carry out the Booked Services.
15. Intellectual Property
  • 15.1. All content of the website and its associated pages, Bensa reserves all intellectual property rights that may persist.
  • 15.2. When you accept the terms and conditions, you will be granted a non-­‐ exclusive license to visit the website, print pages from the website, and download any material from the website for personal purposes only.
  • 15.3. You are not entitled to, without Bensa's prior written consent, copy, republish, reproduce, duplicate or extract Website content or redistribute, sell, rent or license any Website content or edit, modify or vary the Website content.
